We already know that. Most of the patents belong to IBM, who have pledged not to sue Linux developers and companies unless they need to protect themselves by law.
Open-source companies sometimes buy patents Linux and/or other components allegedly are infringing upon.

Yes, about thirty patents or so.
The kernel and FUSE NTFS drivers being one of them.
I've also read somewhere that Microsoft allegedly infridges on some IBM patents and that a lawsuit against Linux and open-source could signal a counter-suit from IBM.
