No, obviously they downloaded it using Napster and then used it in an ad campaign, which they then posted themselves on YouTube. -

Well it's a good thing Beetlejuice brought this to to MS's attention - so they can act on it.
Perhaps MS can pay Trio the misapropriated royalties out of pocket.
Or at the very least request youtube remove the offending IP
* it's about time ms started to act on ALL ip violations - not just patent related ones
