Well that's interesting. A patent application for the Zune that allows you to share music with other Zune users, as usual, but if the receiving user then actually purchases said music, the sender gets a sales commission. And yes, that also works if the sender actually pirated the song rather than buying it.

Once the song is paid for sales commission go to the sender and Zune Marketplace while the bulk of the money would go to the copyright holder.

So do artists usually hold the copyright or is it the record company?

I'll give you 2 guesses

Actually, the songwriting copyright usually goes to the songwriter.  The performance copyright usually belongs to the record company.

For example, if the song is played on the radio, then the record company get's the money (and the artist probably gets a tiny bit of that).  If the song is covered by another band, the the artist gets much more money.

So, you see who gets most of the money, then...

Depends. There are exceptions like Metallica. They did their anti-pirate thing because they actually hold all the rights to their own music. So it was them themselves that had to be a$$holes, and not the RIAA.

But after the record companies did stuff like they did to Creedence Clearwater Revival...record companies don't hold much respect in my book.

So that's copyright infringement (libel in civil law) but also fraud (libel in criminal law).

Microsoft just found a way of ensuring that piracy really is a crime!
