You need to have spaces for the OS itself. And then, it has this awesome feature where you can completely recover your device all the way back to factory condition, which also takes a lot of GBs.

If you don't like the Apps it comes with, you can uninstall them. Uninstall Travel App free up at least 200 MB.

And then, there is File System Directory and VRAM. Those are all common things to reduce the spaces. I am pretty sure those happen on other devices too.

I can definitely see his point there.

Then again, those 16 gigs of occupied space aren't wasted. He bought a tablet that he knew would have Office installed, and there it is, occupying space. If he didn't want that, he should've bought a tablet without Office, and he probably knew that. It's not wasted if it's being put to use for the things you bought the device for.

Then again: that's still a lot of ocuppied space for just Office and Windows.

Then again, if the free space is indeed marked on the box: caveat emptor. It's dissapointing, yes, but lawsuit material?

I guess there's more than one way to look at this story and I either don't care or am not fanboy/anti-fanboy enough to write an enraged forum post about it either way.

Given that this is an argument about the degree of space taken up (not that fact that some space is taken up, because other tablets do take up some space), doesn't that make it a trickier argument in law? It's not that WInRT takes up space, it's that they take up more space than comparable tablets, so the amount of space that would be acceptable is subjective?

I don't see this guy's legal claim going very far to be honest, but it's probably useful to have it highlight the issue of spare capacity so people will start paying more attention to it.

About the only legitimate reason that space could be a problem is if you want to load massive amounts of media on the tablet itself.  The point of the device is that it's cloud connected, so 32gb is just fine for that purpose.

The Pro tabs will have a need for more space, but again, unless you want to make it a file server, 128GB is way plenty even if you include the IDE.

@Dr Herbie:I just checked my monthly download for November and I came in just over 40GB, with very little in the way of streaming.  I do some offsite backup and watch a few TV shows, but nowhere near the amount that would occur with children in the equation.

The final version has been released but is still an optional update. I didn't check the size of things but I imagine it's a bit smaller, assuming the preview had some debug code left in.

That leaves the OS (w/recovery, etc.) taking up around 13GB by my count. Round it down to 10GB and that's still a lot compared to the competition. No doubt RT provides Office where the others don't but to loose more than 10 times the storage as the nearest competitor just for "Windows" with Office IMO is going to be hard for most consumer to accept. With the Office web edition and Office mobile for iOS and Android coming next year it's going to make that space issue even more of a glaring problem.

That said the amount of memory free on a device is just one factor of many that buyers consider. There are other things such as availability of applications, reuse of existing peripherals, and performance that are probably more important.
