Just to set the record straight - it now looks like DRM will not be applied to any file that isn't already infected by it when doing Zune-Zune sharing.

I misspoke (mis-blogged) on last week’s post. We don’t actually “wrap all songs up in DRM:” Zune to Zune Sharing doesn’t change the DRM on a song, and it doesn’t impose DRM restrictions on any files that are unprotected. If you have a song - say that you got “free and clear” - Zune to Zune Sharing won’t apply any DRM to that song.

I've no idea if this is a genuine mistake or a backdown, but it is good news all the same.

backdown or mistake?  well neither really, you can still only play *.mp3 3times/3days you can just keep viewing the id3 tags and such.  though i do wonder what happens on Zune to PC transfers either by Wi-Fi or Zune -> USB

This gives me a warm and fuzzy fealing inside.

As Jaz said, it's more a clarification than anything else. If you share some music from a Zune, the person recieving it can still only listen to it at most three times for up to 3 days. Nothing there has changed.

The only point is that they do not modify the file and thus do not violate CC's style licenses.

WOOH! WOOH!
The 3 times in 3 days IS the DRM.

So, it means that if I share a clear MP3, Zune will leave it clear and you can play it forever.

And it's most likely a backdown.

After reading the blog post, it'd seem that I was wrong. Although, the MP3 isn't changed to apply DRM, you can only play the song 3 x in 3 days. If you ask me, the effectively is DRM.

MS & RIAA has managed to make a potentially killer-app feature into a ho-hum-who-cares feature.

So according to the Wal-mart leak, it's also $45 more than an iPod. Yay!

J Allard's gonna wish he stayed w/ the Xbox 360.
