  • is damaged by programs, data, viruses, or files, or during shipments;
  • is not used in accordance with the accompanying documentation and use instructions; or
  • is opened, disassembled, repaired, modified, or altered by other than Microsoft authorized repair centers.


That basically means, you have no warranty, especially not, when you plug your Zune into a computer of any kind (MS doesn't make those), you use it and scratch it with dirt in your pockets, you're trying to make money selling it, you catch a computer virus (and you couldn't even proove that was never the case), or if Microsoft would simply say it was an act of God, lol.

I have not read many warranty disclaimers, but this is overkill, really.

Had mine replaced no problem. Came in a nice new box.





Problem is I had it replaced because a few dead pixils, my new one has one still. I do not feel like going another week without my Zune at this point. I inspected my friends Ipod touches, none of which have dead pixils. Microsoft is still new to the game, I imagine that will disappear over time...at least it better.

You’ll be hard pressed to find very many warranties on... anything that covers damage due to normal wear and tear, misuse or acts of god.

That you don't get a new one if you happen to be struck by lightning, while listening to your Zune..

But you have to apply a small amount of common sense here. What they're saying is you aren't covered if you start using some dodgy third party power adapter/connection cable or if you use some freetard client software that ends up borking your Zune. As far as the scratches go, that means they won't replace it just because you've scratched it, if it's genuinely failed for some other in-warranty reason then naturally it'll be repaired/replaced.

It all looks fairly standard to me.

I think that scratches means it doesn't cover the scratches, not that invalidates other claims on the warranty also. Also - you have statutory rights which should cover you in case of a manufacturing defect...

Me thinks you need to read some more warranties... the iPod warranty includes:

This warranty does not apply: Angel to consumable parts, such as batteries, unless damage has occurred due to
a defect in materials and workmanship; (b) to cosmetic damage, including but not limited to scratches,
dents, and broken plastic on ports; (c) to damage caused by use with non-Apple products; (d) to damage
caused by accident, abuse, misuse, flood, fire, earthquake or other external causes; (e) to damage caused by
operating the product outside the permitted or intended uses described by Apple; (f) to damage caused by
service (including upgrades and expansions) performed by anyone who is not a representative of Apple or
an Apple Authorized Service Provider (“AASP”); (g) to a product or part that has been modified to alter
functionality or capability without the written permission of Apple; or (h ) if any Apple serial number has
been removed or defaced.
And the one for my MSI Wind contains the text
The limited warranty DOES NOT covers Cosmetic damages, damage or loss to any software programs, data, or removable storage media, or damage due to the following;
(1) Acts of God, accident, misuse, abuse, negligence, commercial use or modifications of the Product;
(2) Improper operation or maintenance of the Product;
(3) Connection to improper voltage supply;
(4) Attempted or unauthorized repair by any party other than MSI.
(5) The warranty seals have been broken or altered.

The limited warranty DOES NOT apply when the malfunction results from the use of the Product in conjunction with accessories, products or ancillary or peripheral equipment, or where it is determined by MSI that there is no fault with the Product itself.

I could go on... but what you see in the Zune warranty is pretty normal.

But I would be covered against frogs, gnats, wild animals, pestilences, locusts and any major plague out of there. The benefits would far outweigh the risks.
