Promises such as the one regarding .NET or, for example, the one involving OOXML, are legally enforceable.  Microsoft can't just publically announce a promise not to sue and then sue people when people take them up on that promise, at least not if they expect to win.

Patent holders make these types of promises all the time in many industries.
