As the latest round of talks on the Anti-Counterfeiting Trade Agreement go on in secret (for unspecified national security reasons), some information on the U.S.-written draft of the Internet chapter has begun to leak out, and, as feared, the heavy hand of the entertainment industry is readily apparent and the implications for Internet service providers, consumers and innovation in general are grim. Being rendered near speechless, I’ll let others summarize:

Secret copyright treaty? Sounds like a deja vu.

 

I hate to be negative, but it's very unlikely that peons like us will be able to influence these treaty or it's passing. That's why it's secret in the first place, they aren't interested in input.

I'm thinking the opposite. The reason it's a secret is because they're afraid of the backlash when people find out.

What? So in the last 38 minutes this went from something that "will probably happen" to something that is actually taking place? Man, I've never seen the system work that fast.

If that was a law the internet would have to close. 

 

No company would allow users to upload content if they could be found liable for copyright violations. Without user content the internet is pointless.

Depends on your system of government and what it takes to ratify a treaty.

 

Example: While it is all but certain that President Obama will sign the Copenhagen 'climate change' treaty later this year... said treaty would never be ratified by the Senate given the requirement of 67 votes for passage under our law.

 

While I cannot say the same thing regarding this treaty... it's fairly unlikely that it would be ratified here as well.

 

The solution? Create a system of government that makes it rather difficult to get involved in such entanglements without a whole heck of a lot of support... and even then place limits on the scope.

Just because it goes by the name of a "treaty" doesn't mean it will be treated like one.

 

The DMCA, originally a WIPO treaty, was treated like a regular law and only require 50% of the House and Senate to become law. Not just that, they also often use a technique such as a "show of hands" (aka voice vote) to pass controversial legislation in secret.

 

Using this technique there will be no way to know which Congresscritter voted for or against the regulations, reducing their accountability and making the number of Congress in favor of the bill unknown. This also occurred for the DMCA.

 

The Constitution in general is a worthless document. It's the monarchy of the USA, respected but with no real power. It hasn't been actively enforced since FDR and the "living document" assertion. What really matters is what the Supreme Court says the Constitution says, not actually what it says.

It seems the faintest glimer of hope is on the horizon...

 

The EU have now said that governments will have to institute a "fair and impartial" procedure to cut people off. Unfortunately they neglect to mention what constitutes fair and impartial.

 

I guess at least the sentiment of appeasing the citizens is there, even if not an actual attempt to do so.
