@Bass: With regard to the whole copyright issue, I think that an important issue here is that software, unlike drugs or clothes, and much like books or movies, can be copied fairly easily.
If I buy a box of pills, I can't duplicate them and resell them unless I know how to make them (and knowing the ingredients isn't enough). But if I buy a book, I can duplicate it using a photocopier. If I buy a piece of software, I can duplicate it using very simple tools that anyone has and can use. I think that's how software ended up being copyrightable.
